website is operated by HTSWEETS. Throughout the site, the terms “we”, “us” and
“our” refer to HTSWEETS. HTSWEETS offers this website, including all
information, tools and services available from this site to you, the user,
conditioned upon your acceptance of all terms, conditions, policies and notices
stated here.
By
visiting our site and/ or purchasing something from us whether that be on the
website, eBay, on the phone, via email or in store, you engage in our “Service”
and agree to be bound by the following terms and conditions (“Terms of
Service”, “Terms”), including those additional terms and conditions and
policies referenced herein and/or available by hyperlink. These Terms of
Service apply to all users of the site, including without limitation users who
are browsers, vendors, customers, merchants, and/ or contributors of content.
It is the buyer’s responsibility to read these Terms and Conditions before
purchase.
Please
read these Terms of Service carefully before accessing or using our website, or
purchasing any products from us whether that be through the website, eBay, on
the phone or in store. By purchasing our products, you agree to be bound by
these Terms of Service. If you do not agree to all the terms and conditions of
this agreement, then you may not access the website or use any services.
Any
new features or tools which are added to the current store shall also be
subject to the Terms of Service. You can review the most current version of the
Terms of Service at any time on this page. We reserve the right to update,
change or replace any part of these Terms of Service by posting updates and/or
changes to our website. It is your responsibility to check this page
periodically for changes. Your continued use of or access to the website following
the posting of any changes constitutes acceptance of those changes.
SECTION
1 - ONLINE STORE TERMS
By
agreeing to these Terms of Service, you represent that you are at least the age
of majority in your state or province of residence, or that you are the age of
majority in your state or province of residence and you have given us your
consent to allow any of your minor dependents to use this site.
You
may not use our products for any illegal or unauthorized purpose nor may you,
in the use of the Service, violate any laws in your jurisdiction (including but
not limited to copyright laws).
You
must not transmit any worms or viruses or any code of a destructive nature.
A
breach or violation of any of the Terms will result in an immediate termination
of your Services.

2 - GENERAL CONDITIONS
We
reserve the right to refuse service to anyone for any reason at any time.
You
understand that your content (not including credit card information), may be
transferred unencrypted and involve (a) transmissions over various networks;
and (b) changes to conform and adapt to technical requirements of connecting
networks or devices. Credit card information is always encrypted during
transfer over networks.
You
agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of
the Service, use of the Service, or access to the Service or any contact on the
website through which the service is provided, without express written
permission by us.
The
headings used in this agreement are included for convenience only and will not
limit or otherwise affect these Terms.

3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We
reserve the right to modify the contents of this site at any time, but we have
no obligation to update any information on our site. You agree that it is your
responsibility to monitor changes to our site.

4 - MODIFICATIONS TO THE SERVICE AND PRICES
All
prices for our goods are in pound sterling and exclude Value Added Tax
(“VAT”) at the relevant ruling on the date of dispatch.
All
items collected or delivered in the UK are subject to VAT (20%) as per UK law.
We are not responsible for claiming VAT from HMRC if an item is shipped abroad
after our delivery. You must contact the HMRC yourself to claim back any
applicable VAT.
Prices
for our products are subject to change without notice.
We
reserve the right at any time to modify or discontinue the Service (or any part
or content thereof) without notice at any time.
We
shall not be liable to you or to any third-party for any modification, price
change, suspension or discontinuance of the Service.
SECTION
5 - PRODUCTS
Certain
products or services may be available exclusively online through the website.
These products or services may have limited quantities and are subject to
return or exchange only according to our Return Policy.
We
have made every effort to display as accurately as possible the colours and
images of our products that appear at the store. We cannot guarantee that your
computer monitor's display of any colour will be accurate.
All
machine pictures are for reference only. Design of models can vary.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
Some products such as compressors are shown in stock on the website, however they need to be ordered which takes 5-6 working days.
SECTION 6 – ORDERS
Payment must be received before goods are dispatched for delivery or collection.
Any orders that are placed on the website for collection, need a verbal confirmation via telephone so that we can confirm we have your order in stock. If this is not done, we are not liable for any journeys made to and from HT Sweets.
Any orders that are placed for collection on the website; if these orders are not collected within a week, HT Sweets has the right to apply re-stock charges and any admin fees.
All orders placed over the phone but need to be collected (if done in person) must be paid over the counter – card payment will not be accepted over the phone.
In the event a customer cancels an order, we reserve the right to charge the customer for any cost incurred up to the time of cancellation.
All website, eBay, phone and in store orders are subject to the T&Cs on this page.
If payment has been made but during packing, we are short of items in your order we will let the customer know as soon as possible and arrange another delivery date or refund of the short item.
Delivery
charges on international orders can be subject to fluctuation depending on
courier service charges incurred by HTsweets.
SECTION
8- DELIVERIES
All orders collected in store will be considered “delivered” once the customer has made payment and taken the item with them in a vehicle or otherwise.
All orders (except parts) for next working day delivery must be paid for before 12.00am. No guarantees of delivery time or day are made or implied. 90% delivery is next day UK mainland (unless otherwise stated) if order placed before 12noon.
All parts orders made before 12.00am will be dispatched next working day from order date on first class royal mail delivery. Parts must be allowed 3 working days to be delivered before they will be considered late.
Customers outside UK mainland may have longer delivery times.
All items collected or delivered in the UK are subject to VAT as per UK law. We are not responsible for claiming VAT from HMRC if an item is shipped abroad after our delivery. You must contact the HMRC yourself to claim back any applicable VAT.
We will not be held responsible for any unseen problems e.g. courier mishap and will not claim on a customer’s behalf for any delays in receiving the order.
We reserve the right to send orders to customers card registered address/PayPal approved address even if it differs from the customers stated delivery address.
Our third-party carriers are not obliged to enter your premises or carry goods upstairs or over uneven ground. It is the responsibility of the customer to ensure that persons taking delivery can move the goods from the delivery point. Where heavy items are to be delivered, including slush machines, delivery will be made on a pallet and a tail lift will be used; delivery will be considered completed when the pallet is off the tail lift.
Deliveries are made by various carriers during their normal business hours. Unless otherwise stated this should be Monday to Saturday from 8:00 to 18:00. It will be the customers’ responsibility to inform us of failed or late deliveries if goods have not arrived when expected.
The customer
must inspect the goods within 24 hours after delivery and give written notice
to HTSWEETS Customer Services of any defect in the goods or of any other
complaint which the customer may wish to make about our service. Any items must
then be returned within 7 days.

Should the customer decide to accept a delivery to them in a damaged condition they must endorse the carrier’s delivery documentation.
Customers may be charged for the redelivery/another attempt at delivery of an order - this charge will depend on items ordered. Once payment for redelivery is confirmed, another date for delivery will be provided.
Any international orders held up in UK customs will be the responsibility of HTsweets HOWEVER any orders held up in receiving countries customs must be handled by customers.
Any costs
incurred by HT Sweets from the courier service for the return of goods will be
charged to national and international customers directly.
If HT Sweets has to claim for any broken or damaged goods that are due to the customer, all claims and court procedures will be endured by the customer. Any court proceedings will take place in Birmingham.
Queries
regarding shortages of goods must be made within 7 working days of dispatch
date.
Queries regarding goods invoiced but not delivered must be made to HTsweets Customer Services within 7 days of the invoice date and the invoice number must be quoted. If the customer fails to give such notice, the goods shall be conclusively presumed to be in all respects in accordance with the contract and free from any defect which would be apparent on reasonable examination, and the customer shall be deemed to have accepted the goods accordingly.
In no
circumstances shall HTsweets be liable to compensate the customer by way of
damages or loss of earnings or otherwise for non-delivery, late delivery or
damaged goods or any loss consequently or otherwise arising from non-delivery,
late delivery or items damaged in transit or by the customer.
SECTION 9
– RETURNS POLICY
7 DAY SATISFACTION GUARANTEES from the time the product is received less shipping and handling. Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. In the event a machine must be returned, it must be returned as it was received (in the case of large machines it must be returned on a pallet).
Several types of goods are exempt from being returned. Perishable goods such as opened syrups, candy floss sugar/flavouring, ice cream powders, ice-cream wafer cones, kernel seeds, sugar cane and any other food items cannot be returned.
Additional non-returnable items: Used machines, promotion posters, lubrifilm, dispensers, serving scoops, tongs and any other food items cannot be returned.
To complete
your return, we require a receipt or proof of purchase.
International customers are not covered for leakage of products during delivery as courier companies do not cover leaking liquid.
In the event that faulty goods have been supplied you must inform us within 24 hours and return the item within 7 days of delivery. After this HTsweets reserves the right to repair or replace the goods at our discretion
In the event that a machine needs to be returned it will be the customer’s responsibility to ensure that the machine is packed correctly and securely and have adequate insurance cover during transit.
SECTION
10 – REFUNDS
If you are shipping an item, you must use a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed within 7 days and a credit will automatically be applied to your credit card or original method of payment.
Any returns
not as a result of a defective or damaged item will be the responsibility of
the buyer.
You must pay for your own shipping costs for returning your item.
Any returns not as a result of a defective or damaged item will be charged 20% for administration and restocking charges of the total value of the products minus shipping/delivery cost per box. Minimum of £28.99 per box or £120.00 per pallet will also be charged.
A 3% charge will also be deducted for PayPal charges.
All products must be returned to the following address with all necessary information to process a refund: HT Sweets, Haider House, 35 Auckland Road, Birmingham, B11 1RH
Shipping costs are non-refundable. If you receive a refund, the cost of shipping will be deducted from your refund. If HTsweets have arranged the return, the costs of return shipping will also be deducted. If the item has been returned by the courier company due to non-collection or it was unable to be cleared through customs, all return charges incurred on HTsweets will be the responsibility of the customer and will be deducted from the refund.

content, products and services available via our Service may include materials
from third-parties.

affiliated with us. We are not responsible for examining or evaluating the

are not liable for any harm or damages related to the purchase or use of goods,
services, resources, content, or any other transactions made in connection with
any third-party websites. Please review carefully the third-party's policies
and practices and make sure you understand them before you engage in any
transaction. Complaints, claims, concerns, or questions regarding third-party
products should be directed to the third-party.

you purchase something from our store, as part of the buying and selling

you choose a direct payment gateway to complete your purchase, it is encrypted

purchase transaction data is stored only as long as is necessary to complete
your purchase transaction. After that is complete, your purchase transaction
information is deleted.
All
direct payment gateways adhere to the standards set by PCI-DSS as managed by
the PCI Security Standards Council, which is a joint effort of brands like
Visa, Mastercard, American Express and Discover.
PCI-DSS
requirements help ensure the secure handling of credit card information by our
store and its service providers.

SECTION
16 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
In
the event that a machine stops working correctly, after 7 days of delivery
HTSWEETS reserves the right to repair or replace the goods at our discretion.
All
machine are subject to a back to base warranty after 7 days of delivery.
"Back to base warranty" means it is the responsibility of the
customer to return and pick up any items sent back to HTsweets for repair.
HTsweets will send all items back in the way received by HTsweets. It is the
customers responsibility to inspect items themselves or via a third
party before accepting to collect the item. Any damage during transit
of item via courier to HTsweets is also responsibility of the customer.
Repairs
can take up 7-30 days. Repaired machines must be collected by the customer with
24 hours after they are ready; late charge: £5.00 per day. The machine must be
collected within 30 days or will be disposed with £50 disposal charge.
HTsweets
accepts no liability whatsoever or howsoever arising in respect of loss, damage
or expense arising from errors in information or advice provided whether or not
due to HTsweets negligence or that of its employees, agents or
subcontractors.
HTsweets
shall not be liable to the customer for any indirect, special or consequential
loss or damage, costs, expenses or other claims for compensation whatsoever
(whether caused by the negligence of HTsweets, its employees or agents or
otherwise) which arise out of or in connection with the supply of the goods or
their use or resale by the customer. HTsweets shall not be liable to the
customer or deemed to be in breach of contract by reason of any delay in
performing, or any failure to perform, any of HTsweets obligations in relation
to goods, provided that the delay or failure was due to any cause beyond
HTsweets reasonable control.
The
entire liability of HTsweets under or in connection with the contract with the
customer shall not exceed the price of the goods.
The
customer will be responsible for ensuring the fitness for purpose of the goods
for the customer’s application.
All
items other than machines and certain parts listed in the terms and conditions
have no warranty.
SECTION
17.1 SLUSH MACHINE WARRANTY
12
month back to base warranty on all Italian slush machines.
Warranty
applicable only if:
The
customer is able to present their valid invoice with a clear serial number/s
stated.
The
model and serial number of the machine is not defaced or removed from the
machine.
HTsweets
slush syrup used – the quality of other products varies greatly and could
damage the machine components. Failure to prove use of HTsweets sold syrup from
the website, eBay or in store will void warranty.
All
major refrigeration components, including compressor, condenser and evaporators
will be considered to be under warranty for 12 months following the date of
purchase. If the freezer fails at any time during the first 12 months following
purchase, then you can contact and return the item back to base for diagnosis
and repairing of the fault which can take up to 7-30 days
Upon
diagnosis of the problem, should it turn out to be a refrigeration fault, but
something linked to a maintenance issue, (but not limited to), a switch, motor,
motor gear, shaft, seal, tap, spring, or other perishable part, we will explain
exactly what is wrong and quote a fee for repairing and if necessary replacing
a particular part. Any queries relating to this should be directed to sales@htsweets.co.uk
Warranty
is void if:
Signs
of inflicted damage as a result of machine dropping onto the floor, something
dropping onto the machine etc.
Customer
neglects routine cleaning, lubrication and maintenance as outlined in the user
manual every 2 weeks – failure to do this can result in leakage of liquid into
the inside of the machine.
Spilt
liquid found on electrical parts within the machine.
The
product used within the machine is not a product either supplied by or approved
by HTsweets.
The
machine is used in any way other than directed by the manufacture.
The
electric power used to power the machine is anything other than mains
electricity supplied through UK national grid.
Machine
is misused including over/under dilution
of the any concentrate (remember the mix is critical to the
consistency of the product and therefore the correct running of the machine).
The
Machine is continued to be used when there is a known fault.
Signs
of prior repair done by any other party other than HTsweets, its agents or
HTsweets authorised personal can be seen.
Warranty
does not include:
Moving
parts including mixing auger, dispensing assemblies and gear motors.
Plastic
parts including tanks, mixing auger, lids, dispensing handles and assemblies
including rubber seals, drip trays, light bulbs, supporting feet, aesthetic
components or any plastic or electronic parts that present defects due to
incorrect handling, modification, and/or servicing or repair by unqualified
personnel.
Gas
is not covered in the warranty
SECTION
17.2 ICECREAM MACHINE WARRANTY

provided by Taylor UK on their Taylor machines
Warranty
applicable only if:
The
customer is able to present their valid invoice with a clear serial number/s
stated.
The
model and serial number of the machine is not defaced or removed from the
machine.
Babbi
ice cream powder used – the quality of other products varies greatly and could
damage the machine components. Failure to prove use of Babbi ice cream powder
from the website, eBay or in store will void warranty.
All
major refrigeration components, including compressor, condenser and evaporators
will be considered to be under warranty for 12 months following the date of

purchase, then you can contact and return the item back to base for diagnosis

will be considered to be under warranty for 12 months following the date of
purchase. If the freezer fails at any time during the first 12 months following
purchase, then you can contact and return the item back to base for diagnosis
and repairing of the fault which can take up to 7-30 days
Upon
diagnosis of the problem, should it turn out to be a refrigeration fault, but
something linked to a maintenance issue, (but not limited to), a switch, motor,
motor gear, shaft, seal, tap, spring, or other perishable part, we will explain
exactly what is wrong and quote a fee for repairing and if necessary replacing
